Former USU linebacker Torrey Green will face Box Elder jury in January 2019
Former Utah State University football player Torrey Green will stand trial for multiple rape charges starting Jan. 4, 2019, announced Judge Brian Cannell Tuesday in Utah’s First Judicial District Court.
Green was scheduled to begin his first trial March 19, but it was postponed when the court ruled to consolidate Green’s seven cases into two and move the trials to Box Elder County. Both came at the request of Green’s attorney, Skye Lazaro.
Green and Lazaro stood before Cannell for a review hearing Thursday morning to schedule the first trial date. The trial would take three full weeks, Cannell said, and the soonest date that he, the defense, the prosecution and a Box Elder courtroom would be available for that amount of time would be around Thanksgiving. Cannell pointed out that it might be difficult to gather a full jury and witnesses for three full weeks around the holiday season, so he proposed waiting until after the new year. Neither Lazaro nor Spencer Walsh, the prosecuting attorney, voiced concerns over the decision.
Cannell then addressed Green, saying he understands that he wants to get the trial over with sooner but that January was the soonest possible. Green has been held in the Cache County Jail without bail since October 2016.
Green’s trial will take place every weekday at 9 a.m. from Jan. 4-25. Cannell scheduled it to begin on a Friday to make up for Martin Luther King Jr. Day Jan. 21. He also scheduled a pre-trial conference Nov. 27 at 10 a.m.
