“Innocent until proven guilty” is the American way.
Editor,
Shame on you Attorney General Mark Schurtleff.
Why has our Attorney General, who is supposed to protect and defend the Constitution and the people, instead secretly written an unconstitutional bill (SB175 “Asset Forfeiture”) that would make people guilty until they can prove their innocence?
He says, in essence, “We need to be able to stop drug dealers by seizing their properties without the inconvenience of legal ‘due process’.” We say, “The people are innocent until proven guilty. Not the other way around.”
He says, “You people don’t understand. This isn’t about Constitutional law, it’s about civil law.” We say, “Wrong, sir. All law is based on the Constitution. If not, that law is ‘null and void’. The job of the AG is to ‘uphold and defend’ the Constitution, not try to figure out ways around it.”
In November of 2000 an incredible 69% of Utah voters said they want “due process” of law, and no financial incentives for law enforcement to steal innocent property. Mr. AG, why is money and power more important to you than the law and the will of the people?
Friends, all it will take for the AG to win is for good people to not call their House Representative today at 538-1029 and invite them to vote “NO” on SB175.
